CH& Helps Heritage Distilling Successfully Navigate Trademark Dispute over Batch No. 12

Case Background:

Founded in Gig Harbor, WA, Heritage Distilling Co. is a craft spirits distillery featuring a water-front tasting room.  Their liquor exploded in popularity locally and quickly grew nationally, winning multiple awards and recognition. With its innovative approach, Heritage produced a Batch No. 12 line of distilled spirits, which includes vodka, bourbon, and gin.  However, the NFL’s Seattle Seahawks and their “12” theme raised an issue with the Batch No. 12 label and trademark.

How CH& Helped:

CH&’s Trademark and Intellectual Property team co-leader Jeff Nelson successfully resolved the trademark dispute and helped Heritage and the Seahawks find a mutually beneficial business solution.  He prepared and prosecuted federal trademark applications, defended the trademark dispute at the USPTO’s Trademark Trial & Appeal Board, and negotiated resolution of the dispute.  

Results:

CH& not only helped negotiate an end to the dispute, but additionally:

  • Heritage registered multiple variations of its Batch No. 12 trademark and label
  • Heritage continues to produce and sell its Batch No. 12 line of distilled spirits, including at retail locations within CenturyLink Field
  • Created a “full-service firm” mentality and assisted Heritage in other legal matters pertaining to IP, corporate, and real estate issues
