CH& Privacy Notice

Cairncross & Hempelmann, P.S. (collectively, “Cairncross,” “we,” “us,” or “our”) is committed to protecting the privacy of its visitors. This Privacy Notice applies to Cairncross’ website, located at www.cairncross.com (the “Site”), and governs data collection and usage on the Site.  By using our Site, you consent to the data practices described in this Notice.

1. Collection of Your Personal Information

In almost all cases, Cairncross collects any information relating to an identified or identifiable individual, such as e-mail addresses, names, home or work addresses, and/or telephone numbers (“Personal Information”) when that individual provides it directly to us.  However, we may obtain Personal Information about you automatically or through our third-party vendors when you interact with our Site.  This information is used by Cairncross for providing services, to maintain the quality of our Site, and to track general statistics regarding use of our Site.

Please keep in mind that if you directly disclose personally identifiable information or sensitive personal data through our Site or submit same to us through our Site, this information may be collected and used by others and is not a secure way to disclose said information if necessary to render our services to you.

Utilizing our Site does not create an attorney-client relationship and no privilege is associated with submissions through our Site.  Please do not send us sensitive Personal Information through the Site’s “Contact Us” page.

If you contact us via our Site’s “Contact Us” page, we will collect your name, email address, the contents of your message, and the date and time of your message.

Cairncross encourages you to review the privacy statements of websites you visit so that you can understand how those websites collect, use, and share your information. Cairncross is not responsible for the privacy statements or other content on third-party websites.

2. Use of Cookies

Our Site uses “cookies” to help you personalize your online experience and/or to collect analytics data including your Personal Information, such as your IP address, device ID, etc., and non-personal data, such as your internet service provider, browser type, OS type, hardware type, geographical region, screen resolution, time zone, etc.

3. Use of Your Personal Information

Cairncross collects and uses your Personal Information to deliver the services you have requested and/or communicate with you to respond to your inquiry, including recruitment-related communications you may send us.  Cairncross will also use your Personal Information to manage the business relationship between us, such as sending service-related communications and invoices.  Cairncross may also use your Personal Information to inform you of other products or services available from Cairncross, such as sending you client alerts, newsletters, event reminders, and/or other marketing materials.  Cairncross may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.  Additionally, Cairncross may utilize your Personal Information to detect and/or prevent actual or potential fraud, illegal activities, including intellectual property infringement, as well as to defend our legal rights and comply with our internal policies and legal obligations.

We may utilize aggregated data that cannot be used to identify particular individuals to improve our Site.

4. Disclosure of Your Personal Information

Cairncross does not sell, rent, or lease its Site visitor’s Personal Information to third parties.

Cairncross may disclose Personal Information with its vendors to the extent necessary for the vendor to provide its services to us.

Additionally, Cairncross will disclose Personal Information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Cairncross; (b) protect and defend the rights or property of Cairncross; and/or (c) act under exigent circumstances to protect the personal safety of users of the Site or the public.

If we are involved in a merger, acquisition, reorganization, financing, due diligence, or liquidation where our business will not continue, there is a sale of our assets, or transition of our products and/or services to another firm, then we may transfer your Personal Information as permitted by law and/or contract.

Cairncross does not collect, use, or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent.

5. Your Choices

When you provide us with Personal Information, utilize our Site, and/or our client portals, you consent to Cairncross and our vendor’s collection of your Personal Information and using it in connection with your request, the Site, and/or our client portals, as applicable.

If we use your Personal Information for a secondary reason, such as for marketing purposes, we will provide you with an opportunity to opt-out by providing opt-out instructions contained in our marketing communications.

If you change your mind after providing Personal Information, you may withdraw your consent for the continued collection, use, or disclosure of your information by contacting info@cairncross.com.  However, we may retain particular information as needed for our legitimate business purposes or as required by law.

California Residents
Subject to the limitations under California Civil Code § 1798.83, if you are a California resident and have an established business relationship with us, you may ask us to provide you with a list of certain categories of Personal Information that we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year.  You may also request the identity of certain third parties that received your Personal Information from us for their direct marketing purposes during the immediately preceding calendar year. You may make a request as described above once a year.

6. Links to Third-Party Websites

Our Site may include links or embed information on our Site to/from third-party websites, services, applications, and/or content, such as Facebook, Twitter, LinkedIn, etc.  These third parties are separate entities from us and have their own privacy practices.  We strongly recommend you review the privacy notices of these separate entities to fully understand how each of these entities uses your Personal Information.  We encourage you to contact the providers for additional details pertaining to their privacy practices that may allow collection of your Personal Information by any such entities.

In particular, please remember that certain third parties may be located in or have facilities that are located in a different jurisdiction than either you or us.  If you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your Personal Information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our Site and/or other online services or are redirected to a third-party website or application, you are no longer governed by this Privacy Notice and Cairncross is not responsible for the content or policies maintained at these third-party websites.

Do Not Track Signals: Cairncross does not process or respond to “Do Not Track” signals from your browser or other mechanisms that enable consumer choice regarding the collection of personal information about your online activities over time and across third-party websites or online services.

7. Data Retention

Cairncross will store your collected Personal Information for as long as necessary for the purpose the Personal Information was collected or any additional purposes you request of us and for our legitimate business uses, as well as in accordance with our legal obligations.  We may keep your information in a form that does not identify you, e.g., anonymized data, for longer periods of time.

8. Protecting Your Personal Information

Cairncross maintains physical, technical, and administrative measures and processes to protect your Personal Information.  Cairncross follows usual and customary industry practices to ensure your information is not inappropriately lost, misused, accessed, disclosed, altered, destroyed, or otherwise processed.  However, no information system is 100% secure, so we cannot guarantee the absolute security of your Personal Information.

9. Age of Consent

By using our Site and/or other online services, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use our Site and/or other online services.

To the extent applicable, Cairncross complies with the requirements of the Children’s Online Privacy Protection Act.  We do not target our offerings towards or knowingly collect any Personal Information from children under 13 years of age.

10. Changes to This Privacy Notice

We may modify this Privacy Notice from time to time, so please review it frequently. The “Last Updated” date at the top of this Notice indicates when we last revised our Privacy Notice.  Changes and clarifications will take effect immediately upon their posting on our Site.  If Cairncross makes material changes to this Privacy Notice, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use the collected information, and under what circumstances, if any, we disclose it.
