Client Alert: BREAKING NEWS: FTC Rule Banning Non-Competition Agreements Struck Down

The FTC’s rule banning non-competition agreements, set to take effect on September 4, 2024, was struck down by a federal court in Texas yesterday.

As you may recall from our last client alert, earlier this year the FTC made a ruling that would have rendered non-competition agreements unenforceable in most circumstances.

While the FTC may appeal the decision, as of today, the rule banning non-competes will NOT go into effect. We will continue to monitor the situation closely to keep you informed as the legal landscape around this issue remains in flux.
