CH& Attorneys Terence Scanlan, Lindsey Pflugrath, Troy Hatfield, and Nicole Springstroh Published in the ABA “Design Professional’s Guide to Construction Law”

CH& Attorneys Terence Scanlan, Lindsey Pflugrath, Troy Hatfield, and Nicole Springstroh authored a chapter in the latest edition of the ABA “Design Professional’s Guide to Construction Law.”

The Guide covers fundamental design and construction issues inherent to any project and examines new and emerging topics in the design and construction industries.  The chapter authored by the CH& attorneys is titled “The Design Professional and Tort Liability.”  The chapter addresses potential claims that could be made against design professionals, including Negligence, Strict Liability, Breach of Fiduciary Duty and more.  The Chapter also addresses evolving concepts of note to design professionals, including the Economic Loss Doctrine, the enforceability of Limitation of Liability clauses and other risk-shifting contractual mechanisms affecting tort liability.
